In this paper we argue that the consensus around normative standards for the ethics of research in clinical trials, strongly influenced by the Declaration of Helsinki, is perceived from various quarters as too conservative and potentially restrictive of research that is seen as urgent and necessary. We examine this problem from the perspective of various challengers who argue for alternative approaches to what ought or ought not to be permitted. Key themes within this analysis will examine these claims and argue (...) they have implications for the interests of the research subject, research governance and regulation. Using our work with TREAT-NMD, the neuromuscular clinical trials network, we posit that there is a place for advancing the discourse of moral rights and moral duties in the context of research, especially from the perspective of patients and their families, and for including the politics of patient activism and empowerment. At the same time we remain vigilant to the danger that the therapeutic misconception and other serious vulnerabilities for the patient population in clinical trials, are at risk of being overlooked. During the last twenty years in Latin America, there has been a rise in governments drawn from self-defining progressive political currents. Consequently a revitalization is underway of the debate on the viability, pertinence, and characteristics of the welfare state in the twenty-first century. In this context, the present article explores emerging social practices that redefine the various senses of the public space; practices that go beyond nation states, situated in a global territoriality, articulating languages and eliciting emotions capable of producing (...) new socialities. The multitude is discussed as a social subject capable of generating transformative practices. Specifically, the article analyzes the way in which the singularities of occupations raise further questions for nation states. Although the therapeutic misconception (TM) has been well described over a period of approximately 20 years, there has been disagreement about its implications for informed consent to research. In this paper we review some of the history and debate over the ethical implications of TM but also bring a new perspective to those debates. Drawing upon our experience of working in the context of translational research for rare childhood diseases such as Duchenne muscular dystrophy, we consider the ethical and legal (...) implications of the TM for parental consent to research. In this situation, it is potentially the parent who is vulnerable to TM. In our analysis we not only consider the context of informed consent for research but also the wider environment in which the value of research is promoted, more broadly through the media but also more specifically through the communication strategies of patient organizations. All dissemination about developments in research for health runs the risk of portraying an overly optimistic view of the promise of biotechnological solutions and has the potential to encourage a ‘collective’ TM. In this paper we consider the challenge that TM presents to parents as well as explore the ethical and legal responsibilities of researchers to ensure an appropriately informed consent: compatible with a hopeful disposition of parents who consent for the their children whilst avoiding a blind and misleading optimism. Nuestro objetivo es examinar por qué la confianza puede ser considerada como una emoción secundaria y cómo ésta se aborda de diferente manera en un contexto estético u ordinario, lo cual proporciona otro modo de investigar las emociones secundarias_. _Nuestra tesis se desarrolla en tres secciones y una conclusión. En la primera sección, hemos desarrollado ejemplos y hecho observaciones a modo de análisis para probar por qué las narrativas son importantes para nuestras emociones secundarias. En la segunda sección, hemos examinado (...) por qué la confianza puede ser considerara como una emoción secundaria así como establecer un criterio para identificarla como tal_. _En la tercera sección, presentamos una de las funciones de la confianza, el intercambio de conocimiento entre agentes, cuando se comparte conocimiento en un proceso epistémico con otros. L’enfant placé a souvent vécu des traumatismes qui ont impacté sa capacité à réguler ses émotions dans les relations interpersonnelles. Afin d’aider les assistants familiaux et les parents à mieux s’ajuster à l’enfant ont été instaurés des temps d’observation dans les conditions naturelles des interactions adulte-enfant qui ont été enregistrés en vidéo. Le vidéo-feedback a ensuite été utilisé avec chacun des adultes. L’exemple de Matthias montre comment ce dispositif a permis aux parents d’identifier les conséquences de leur comportement sur leur (...) enfant. L’exercice a été plus difficile pour l’assistante familiale davantage centrée sur ses besoins. (shrink)

The chapters cover first ritual and then myth, rooting the account in the practices of the classical city while also taking seriously the world of the imagination. For this edition the bibliography has been substantially revised to meet the needs of a mainly student, English-speaking readership. This article considers the recent publications of French philosopher Simone de Beauvoir, and offers an overview of contemporary scholarship in Beauvoir Studies. Beauvoir’s canonization in Gallimard’s La Pléiade collection in 2018 is discussed, specifically Gallimard’s choice of Beauvoir’s Mémoires for these first two volumes. Exploring the imbrication of Beauvoir’s philosophy with her own lived experience, the article traces what Annie Ernaux describes as the ‘running threads’ connecting us, namely the ways in which Beauvoir’s legacy is interwoven in our lives today. Surveying recent scholarship highlights the pertinence of Beauvoir’s work to contemporary contexts on issues ranging from sexual violence, subjective agency and female subjugation to emancipatory politics and transnational feminist solidarities. Thereafter, the importance Beauvoir placed on self–Other relations is explored in relation to scholarship on Beauvoir’s epistolary exchanges, the publication of her lost novella Les Inséparables, and on Beauvoir’s philosophy of alterity and old age in light of the pandemic. At the beginning of his philosophical career (between 1918 and 1921), the young Heidegger analyzed various texts belonging to the field of the religious tradition: the Pauline Epistles, Augustinian writings and texts of the medieval mystics. Through these analyses, Heidegger formalized certain phenomena that we can find, a few years later, in Being and Time, illustrating the “warm” line of the existential analytic, the pathetic level of the ontology of Dasein: anxiety, death, consciousness, and guilt. My paper focuses on this (...) process of ontologization of phenomena belonging to religious life, namely on the awaiting of Parousia which is used to elaborate the futural structure of being towards death. I finally argue that the keyword for the understanding of the phenomenological transfer from the religious life to the ontology of Dasein is the methodological idea of “formal indication”, whose meaning and role must be clarified. The notion of emergence has accompanied philosophy of science since the late XIX century, claiming that in some systems there are properties in certain levels that cannot be deduced from properties of their components as seen in more fundamental levels. Throughout the XX century, emergence has been characterized by four pillars: unpredictability, novelty, restriction and downward causation. These four pillars have been related to the assumption of a hierarchical order of reality in different levels of organization. Gravity and Grace was the first ever publication by the remarkable thinker and activist, Simone Weil. In it Gustave Thibon, the priest to whom she had entrusted her notebooks before her untimely death, compiled in one remarkable volume a compendium of her writings that have become a source of spiritual guidance and wisdom for countless individuals.

Particle indistinguishability has always been considered a purely quantum mechanical concept. In parallel, indistinguishable particles have been thought to be entities that are not properly speaking objects at all. I argue, to the contrary, that the concept can equally be applied to classical particles, and that in either case particles may (with certain exceptions) be counted as objects even though they are indistinguishable. The exceptions are elementary bosons (for example photons).

We demonstrate that the quantum-mechanical description of composite physical systems of an arbitrary number of similar fermions in all their admissible states, mixed or pure, for all finite-dimensional Hilbert spaces, is not in conflict with Leibniz's Principle of the Identity of Indiscernibles (PII). We discern the fermions by means of physically meaningful, permutation-invariant categorical relations, i.e. relations independent of the quantum-mechanical probabilities. If, indeed, probabilistic relations are permitted as well, we argue that similar bosons can also be discerned in all (...) their admissible states; but their categorical discernibility turns out to be a state-dependent matter. In all demonstrated cases of discernibility, the fermions and the bosons are discerned (i) with only minimal assumptions on the interpretation of quantum mechanics; (ii) without appealing to metaphysical notions, such as Scotusian haecceitas, Lockean substrata, Postian transcendental individuality or Adamsian primitive thisness; and (iii) without revising the general framework of classical elementary predicate logic and standard set theory, thus without revising standard mathematics. This confutes: (a) the currently dominant view that, provided (i) and (ii), the quantum-mechanical description of such composite physical systems always conflicts with PII; and (b) that if PII can be saved at all, the only way to do it is by adopting one or other of the thick metaphysical notions mentioned above. Among the most general and influential arguments for the currently dominant view are those due to Schrodinger, Margenau, Cortes, Dalla Chiara, Di Francia, Redhead, French, Teller, Butterfield, Giuntini, Mittelstaedt, Castellani, Krause and Huggett. We review them succinctly and critically as well as related arguments by van Fraassen and Massimi. (shrink)

I show that frequentism, as an explanation of probability in classical statistical mechanics, can be extended in a natural way to a decoherent quantum history space, the analogue of a classical phase space. The result is a form of finite frequentism, in which Gibbs’ concept of an infinite ensemble of gases is replaced by the quantum state expressed as a superposition of a finite number of decohering microstates. It is a form of finite and actual frequentism (as opposed to hypothetical (...) frequentism) insofar as all the microstates exist, in keeping with the decoherence-based Everett interpretation, and some versions of pilot-wave theory. One Stoic response to the skeptical indistinguishability argument is that it fails to account for expertise: the Stoics allow that while two similar objects create indistinguishable appearances in the amateur, this is not true of the expert, whose appearances succeed in discriminating the pair. This paper re-examines the motivations for this Stoic response, and argues that it reveals the Stoic claim that, in generating a kataleptic appearance, the perceiver’s mind is active, insofar as it applies concepts matching the perceptual stimulus. (...) I argue that this claim is reflected in the Stoic definition of the kataleptic appearance, and that it respects their more general account of mental representation. I further suggest that, in attributing some activity to the mind in creating each kataleptic appearance, and in claiming that the expert’s mind allows her to form more kataleptic appearances than the amateur, the Stoics draw inspiration from the wax tablet model in Plato’s Theaetetus (190e–196d), where Socrates distinguishes the wise from the ignorant on the basis of how well they match sensory input with its appropriate mental ‘seal’ (σφραγίς). The central claim of this article is that post-truth requires a political and socio-economical perspective, rather than a moral or epistemological one. The article consists of two parts. The first part offers a critical examination of the dominant analyses of post-truth in terms of shifting standards of the origin and the evaluation of facts. Moreover, the claim that postmodernism is the cause of post-truth is examined and refuted. In the second part an alternative perspective is developed, centring around the notion (...) of gatekeepers. Rather than linking post-truth to bullshit and postmodernism, it should be understood as a symptom of a contemporary shift in the gatekeepers of truth and knowledge. Knowledge and truth are always mediated in society through the hands of gatekeeping institutions such as journalism or science. Post-truth is a symptom of a broader transformation of the gatekeeping institutions of our current society. It therefore requires a political philosophy of these institutional shifts and the new risks they involve. (shrink)

Simone Weil's Leçons de Philosophie are derived from a course she taught at the lyce;e for girls at Roanne in 1933-4. Anne Reynaud-Gue;rithault was a pupil in the class; her notes are not a verbatim record but are a very full and, as far as one can judge, faithful rendering, often catching the unmistakable tone of Simone Weil's voice as well as the force and the directness of her thought. The lectures form a good general introduction to philosophy, ranging widely (...) over problems about perception, mind, language, reasoning and problems in moral and political philosophy too. Her method of presentation is a characteristic combination of abstract argument, personal experience and literary or historical reference. Peter Winch points out in his introduction to the book some of the more systematic connections in her philosophical work (and between this philosophical work and her other concerns), and makes a number of suggestive comparisons between Simone Weil and Wittgenstein. The translation is by Hugh Price from the Plon edition of 1959. Dr Price has added some notes to explain references in the text that might be unfamiliar to English speaking students beginning philosophy. (shrink)

Intellectual property regimes necessarily create artificial scarcity leading to wastage, both by blocking follow-up research and hindering access to those who are only able to pay less then the actual retail price. After revising the traditional arguments to hinder access to people’s intellectual labour we will examine why we should be more open to allow free-riding of inventive efforts, especially in cases where innovators have not secured the widest access to the fruits of their research and failed to cooperate with (...) follow-up innovators. We will do so by questioning the voluntariness involved in consumption of objects of innovation, restating the positive social externalities that arise when wider access to the fruits of innovation is assured, and examining the eventual harms innovators face. Food security brings a number of benefits to humanity from which nobody can be excluded and which can be simultaneously enjoyed by all. An economic understanding of the concept sees food security qualify as a global public good. However, there are four other ways of understanding a public good which are worthy of attention. A normative public good is a good from which nobody ought to be excluded. Alternatively, one might acknowledge the benevolent character of a public good. Others have (...) argued that public goods demand being public in the sense of being visible to all. Finally, it has also been argued that public goods are those goods which need joint action to be produced and maintained. This chapter discusses these five understandings of the public good in relation to food security and highlights the advantage of assessing policies from each of these perspectives. (shrink)

This paper offers a critical analysis of Stalnaker''s work on presupposition (Stalnaker1973, 1974, 1979, 1999, 2002). The paper examines two definitions of speaker presupposition offered by Stalnaker – the familiar common ground view, and the earlier,less familiar, dispositional account – and how Stalnaker relates this notion to the linguistic phenomenon of presupposition. Special attention is paid to Stalnaker's view of accommodation. I argue that given Stalnaker's views, accommodation is not rightly seen as driven by the presuppositional requirements of utterances, but (...) only by the interests of speakers in eliminating perceived differences among presuppositions. I also consider the revisions which are needed either to the definition of speaker presupposition or to the definition of sentence presupposition in light of the possibility of informative presupposition. In the concluding section, I discuss the ways in which some recent accounts of context and speaker presupposition depart from their Stalnakerian foundations. (shrink)

Education as identity formation in Western-style liberal-democracies relies, in part, on neutrality as a justification for the reproduction of collective individual identity, including societal, cultural, institutional and political identities, many aspects of which are problematic in terms of the reproduction of environmentally harmful attitudes, beliefs and actions. Taking a position on an issue necessitates letting go of certain forms of neutrality, as does effectively teaching environmental education. We contend that to claim a stance of neutrality is to claim a position (...) beyond criticism. In the classroom this can also be an epistemically damaging position to hold. To further explore the problem of neutrality in the classroom, and to offer a potential solution, we will look to the philosophical community of inquiry pedagogy, and advocate for the addition of place-based education; a form of experiential education that promotes learning in local communities in which the school is situated, each with its own history, culture, economy and environment. However, how we understand ‘place’ is fundamental to understanding the potential of place-based education in giving students a ‘sense of place’—how they perceive a place, which includes place attachment and place meaning. To this end, we look to Indigenous understandings of Place and social reconstruction learning to inform place-based pedagogies. Doing so, we hold, opens a pathway to ethical education. (shrink)

The mixture of political, social, cultural and economic environments in Latin America, together with the enormous diversity in climates, natural habitats and biological resources the continent offers, make the ethical assessment of agricultural policies extremely difficult. Yet the experience gained while addressing the contemporary challenges the region faces, such as rapid urbanization, loss of culinary and crop diversity, extreme inequality, disappearing farming styles, water and land grabs, malnutrition and the restoration of the rule of law and social peace, can be (...) of great value to other regions in similar latitudes, development processes and social problems. This chapter will provide a brief overview of these challenges from the perspective of a continent that is exposed to the consequences of extreme inequality in multiple dimensions and conclude by arguing for the need to have a continuous South-South dialogue on the challenges of establishing socially and environmentally sustainable food systems. The debate about how neurotechnologies impact authenticity has focused on two inter-related dimensions: self-discovery and self-creation. In this paper, we develop a broader framework that includes the experimental and relational dimensions of authenticity, both understood as decisive for shaping one’s narrative identity. In our view, neurointerventions that alter someone’s personality traits will also impact her very own self-understanding across time. We argue that experimental authenticity only needs a minimum conception of narrative coherence of the self and that reversibility should remain (...) a key feature in the ethical assessment of neurotechnologies. The relational dimension of authenticity derives from the fact that a process of self-constitution is never a solitary business. The significant others act not just as subsequent judges of one’s life decisions, but as real co-authors of one’s self. We discuss relevant cases in which others are actively contributing to the meaning-making process, as to the direction one’s life is taking. We also claim that the experimental and the relational dimensions of authenticity should aim to correct each other. The relational dimension introduces socially approved standards as well as limitations to the array of available possibilities of self-fashioning or human enhancement. The experimental side enables us to avoid confusing one’s personal identity with a social and narrative construct that only bears the mark of social pressure and conformism. (shrink)

Post-modernism offers a revolutionary approach to the study of society: in questioning the validity of modern science and the notion of objective knowledge, this movement discards history, rejects humanism, and resists any truth claims. In this comprehensive assessment of post-modernism, Pauline Rosenau traces its origins in the humanities and describes how its key concepts are today being applied to, and are restructuring, the social sciences. Serving as neither an opponent nor an apologist for the movement, she cuts through post-modernism's often (...) incomprehensible jargon in order to offer all readers a lucid exposition of its propositions. Rosenau shows how the post-modern challenge to reason and rational organization radiates across academic fields. For example, in psychology it questions the conscious, logical, coherent subject; in public administration it encourages a retreat from central planning and from reliance on specialists; in political science it calls into question the authority of hierarchical, bureaucratic decision-making structures that function in carefully defined spheres; in anthropology it inspires the protection of local, primitive cultures from First World attempts to reorganize them. The 1929 encounter between Ernst Cassirer and Martin Heidegger in Davos, Switzerland is considered one of the most important intellectual debates of the twentieth century and a founding moment of continental philosophy. At the same time, many commentators have questioned the philosophical profundity and coherence of the actual debate. In this book, the first comprehensive philosophical analysis of the Davos debate, Simon Truwant challenges these critiques.
